Domicile Address Pitfalls: In re Solace Cine LLC

The Board recently affirmed the refusal of several marks because the applicant provided their counsel’s law firm address as their domicile without stating it was their principal place of business.

• McBrayer Commentary: We are seeing a strict "crackdown" by the USPTO on domicile requirements to combat fraudulent filings. For our clients, this is a warning: using a law firm or a P.O. Box as a "placeholder" address on an application can lead to a fatal refusal that cannot be cured by a simple amendment later.
