Overview
Colin Buckner’s law career has seen a meteoric rise since he graduated from Lincoln Memorial University's Duncan School of Law in 2019. He has since handled a wide range of litigation cases, including minor fender benders to police §1983 litigation, employment disputes, and wrongful death. His practice consists mainly of insurance defense litigation, with a focus on motor vehicle accident defense, premises liability, and police misconduct claims. Colin values clear communication with his clients and makes sure to understand their needs to build trust and confidence in his practice.
Colin enjoys spending time with his wife and their son when he isn’t working hard for his clients. He is an active member of the Bethel Baptist Church in Harrodsburg, KY, and the Danville Country Club. In his free time, he enjoys working on his farm, playing golf, and rooting for the University of Kentucky and Chicago Cubs.
Capabilities, Successes, and Assignments
- Practiced as a criminal prosecutor and assistant district attorney in Tennessee
- Drafted and argued Motions in Limine, Motions for Summary Judgment, and Appellate briefs for the Kentucky Court of Appeals and Supreme Court of Kentucky
- Obtained numerous dismissals through Motions for Summary Judgment in Circuit and Appeals Courts
- Represented an RV/Camper Business in a premise/motor vehicle accident liability claim based on view obstruction where the Plaintiffs asked the jury for $17 million resulting in a unanimous defense verdict in his client's favor.
- Second chair at one trial in January 2024 and awarded a unanimous defense verdict. Shipp & Heath v. Arrowhead Camper Sales, Inc., 18-CI-00396.
Published Cases:
- In Haney v. City of Paintsville (Supreme Court of Kentucky 2023-SC-361), Mr. Buckner successfully defended the City of Paintsville and its police officers in connection with the arrest of decedent Prater, who attacked officers as they attempted to arrest him. Prater had been taken to the hospital but fled after tearing a phone off the wall and threatening staff. He was running through the city streets while naked. When officers reached him, Prater tried to attack them several times before finally being apprehended. Soon after, he became non-responsive. The efforts to save his life were unsuccessful. A wrongful death suit followed, alleging the officers were negligent and that the City and its police department negligently hired, trained, and supervised the officers. Full dismissals were secured at the trial court but were partially overturned by a subsequent Court of Appeals decision. However, the Supreme Court reaffirmed and reinstated the trial court’s ruling, determining that the clients were protected by immunity and that no facts of record suggested any man acted unreasonably or in bad faith to prevent the application of immunity.
