McBrayer Member Ed Monarch Secures Reversal of Medical Board Decision in License Case

A Jefferson Circuit Court has reversed the Kentucky Board of Medical Licensure’s decision to revoke the licenses of two Muhlenberg County physicians, ruling the Board acted without substantial evidence.

McBrayer Member Ed Monarch, who represented Dr. William Vincent, called the decision a major victory for addiction treatment in Kentucky. Monarch emphasized that Kentucky’s current regulations on buprenorphine, an essential medication for opioid addiction treatment, are widely considered outdated.

“Numerous medical organizations, including the American Medical Association and the American Society of Addiction Medicine, have condemned Kentucky’s buprenorphine regulation as a barrier to effective care,” Monarch said. “Currently, legislation is proposed to prevent the Board from unreasonably restricting access to buprenorphine products like Suboxone and Sublocade.”

Monarch added:
“Dr. Vincent and Dr. Hardison practiced state-of-the-art addiction medicine and were phenomenally successful in helping substance use disorder patients return to productive lives. We are very grateful to the Court for its oversight and correction of improper Board action.”
